Gul Mir Khan and others V. Government of Balochistan through Secretary Education Balochistan Quetta Civil Secretariat Quetta and others,

PLJ 2023 Quetta 39 · Balochistan High Court

This case was about complaints from three job applicants seeking teaching positions in Balochistan's Education Department under the quota reserved for persons with disabilities.

Petitioners 1 and 2 wanted appointment as Junior Vernacular Teachers (JVT) in District Zhob, while Petitioner 3 sought appointment as a Junior English Teacher (JET) in District Sherani, all against posts reserved for disabled persons under the Disabled Persons (Employment and Rehabilitation) Ordinance, 1981 and related civil service rules. Their appeals against rejection had earlier been dismissed by a departmental complaint redressal cell.

The High Court examined how the disability quota should be calculated, relying on Supreme Court guidance that the quota must be based on total sanctioned posts in the department, and that recruitment advertisements must clearly state how many quota seats are available.

For Zhob, the court found the disabled-quota post had already been filled by another candidate who scored higher marks than Petitioners 1 and 2. Since that appointment was made fairly on merit, the court ruled Petitioners 1 and 2 were not entitled to relief.

However, for Sherani, the court found Petitioner 3 had qualified through the required test, had a verified disability certificate, and that no disabled candidate had actually been appointed against the reserved post there. The court therefore ruled in his favor, directing that he be considered entitled to appointment.

The case matters because it clarifies how disability quotas in government jobs should be calculated and enforced fair
