Suit for Cancellation of Partition
PLJ 2023 Quetta 130 · Balochistan High Court
This case involved a dispute over land in Quetta district. The plaintiffs (respondents in this petition) had filed a suit seeking declaration, cancellation of partition, transfer of mutation, specific performance, and related relief, claiming their predecessor had purchased the disputed land through a 1995 agreement that was never fully acted upon, leaving the property still recorded in the name of the defendants predecessor.
The defendant (petitioner here) asked the trial court to reject the plaint outright under Order VII Rule 11 of the Civil Procedure Code, arguing the agreements did not match the property's survey numbers and that disputes over revenue record entries could only be handled by revenue authorities, not civil courts. The trial court agreed and rejected the plaint. On appeal, the appellate court overturned that decision and sent the case back for a full trial. The defendant then challenged that reversal before the High Court.
The High Court upheld the appellate court's decision, dismissing the defendant's petitions. It held that a plaint can only be rejected if it is clearly barred by law based on its own contents, not by considering the defendant's objections or the merits of the case. Since genuine, serious factual disputes existed, particularly about ownership and the authenticity of the agreement, these could only be resolved through evidence and a proper trial, not by dismissing the case at the outset. The ruling reinforces that civil courts have jurisdiction to protect legal rights and that factual disputes must go to trial rather than be cut short procedurally.
