PLJ 2023 Quetta 130 · Balochistan High Court

This case involved a property dispute over land in Quetta, Balochistan. The plaintiffs claimed their predecessor had purchased the disputed land through a 1995 agreement, but the agreement was allegedly never acted upon and the property remained registered under the sellers' names. They filed a civil suit seeking declaration of ownership, cancellation of partition, transfer of mutation (land revenue records), and specific performance of the sale agreement.

The defendant (petitioner in this case) asked the trial court to reject the plaint outright, arguing the agreements were vague, didn't match the property's official survey numbers, and that correcting revenue records fell solely under the jurisdiction of revenue authorities, not civil courts. The trial court agreed and dismissed the case without a full trial. On appeal, the Additional District Judge overturned this and sent the case back for proper trial.

The High Court upheld the appellate court's decision, dismissing the petitioner's challenge. It ruled that rejecting a plaint early on is only appropriate when the claim is clearly barred by law on its face—courts cannot weigh evidence or disputed facts at that stage. Since genuine factual disputes existed, including the validity of the agreement and property ownership, these needed to be resolved through evidence and trial, not dismissed prematurely. The court emphasized that civil courts generally have jurisdiction over such disputes unless specifically barred by law, reinforcing the principle that a person with a legal right must have an avenue to seek remedy in court.
