Complaint for separation of share in Father's Legacy

PLJ 2023 Peshawar 94 · Peshawar High Court

This case involved a dispute over the inherited property of the late Alam Khan. Some female heirs filed a civil suit before a Civil Judge in Mardan seeking declaration, partition, and recovery of profits from their share. While that suit was still pending, they also filed a separate complaint before the Khyber Pakhtunkhwa Ombudsman (Women's Property Rights) under a 2019 law meant to protect women's property rights, asking for their share to be separated. The Ombudsman ordered that the entire disputed property be attached and sealed until the complaint was decided. The other heirs, who were already contesting the civil suit, challenged this sealing order, arguing it was illegal and deprived them of income from the property.

The Peshawar High Court examined whether the Ombudsman had the authority to order such attachment and sealing while a civil court was already handling the same property dispute. The Court held that sealing property is not supported by law, and that attachment must follow proper procedures under the Civil Procedure Code. It ruled that once a matter is already pending before a competent civil court, the Ombudsman should generally step back, since proceeding otherwise could conflict with the constitutional separation of powers between the judiciary and executive bodies like the Ombudsman. The sealing order was set aside, though the earlier attachment order was allowed to continue. The case clarifies the limits of the Ombudsman's powers when courts are already seized of the same dispute.
