A female child between the age of 10 to 15 needs her mother the most

PLJ 2023 Lahore 912 · Lahore High Court

This case involved a custody dispute between divorced parents over their young daughter, Hareem Fatima. The father, a Pakistan Army Colonel, had initially won custody from the Guardian Court in Mianwali, partly because the child herself expressed a preference to live with him. The mother, a doctor, appealed, and the Additional District Judge reversed that decision, awarding her custody instead while giving the father a visitation schedule. The father then challenged this reversal before the Lahore High Court.

The High Court upheld the mother's custody, dismissing the father's petition. The judge reasoned that while the child's preference and her bond with her father were genuine and noteworthy, a child's stated preference alone cannot be the sole basis for custody decisions, especially when the mother has not remarried and has no competing family obligations besides raising the child. The court emphasized that a girl between ages 10 and 15 undergoes significant biological and emotional changes during which she especially needs her biological mother, rather than a father, stepmother, or grandmother. It also noted the mother's professional stability as a doctor made her well-suited to provide care.

The case matters because it reinforces that in custody disputes, courts must weigh the holistic welfare of the child, particularly daughters at sensitive developmental stages, rather than relying solely on a child's expressed preference, and affirms that a mother's remarriage status—not her career—is the key factor weighed against her custodial rights.
