Complaint before Ombudsperson during pendency of Suit
PLJ 2023 Lahore 307 · Lahore High Court
This case involved a dispute over inheritance rights under the Punjab Enforcement of Women's Property Rights Act, 2021. A widow and her daughters filed a complaint with the Punjab Ombudsperson, alleging that their rightful shares in the deceased husband's property had been fraudulently taken from them through a fake gift deed in favor of the sons. However, before filing this complaint, the women had already filed a civil suit in court seeking to have the same gift declared invalid, and that suit was still pending when the Ombudsperson took up the complaint.
The sons challenged the Ombudsperson's decision, arguing she had no authority to decide the matter while the civil suit was still pending, and that she failed to follow the specific procedure required by law, which mandates that when a related case is pending in court, the Ombudsperson must file a report with that court and wait for permission before proceeding further.
The Lahore High Court agreed with the sons. It found that the Ombudsperson ignored the pending court case and failed to follow the mandatory procedure under Section 7 of the Act. The Court also noted that the Ombudsperson improperly made her order's implementation conditional on the women withdrawing their civil suit, something the law did not permit. As a result, the Court declared the Ombudsperson's order legally flawed and allowed the petition, while clarifying that the law itself was not unconstitutional.
