Judgment on Punjab Partition of Immovable Property Act 2012

PLJ 2023 Karachi 124 (DB) · Sindh High Court

This case involved a family dispute over a house in Karachi left behind by a woman who died in 1993, with her two sons as heirs. After one son also passed away, his many children (the appellants) and the other son (respondent) could not agree on how to divide the property, so a partition suit was filed. Since the property could not be physically divided among so many heirs, the court appointed a Nazir (court officer) to arrange its sale, first by private agreement among the family, then by auction if needed.

Disputes arose over the property's value. The respondent offered to buy it for Rs. 3 crore, but the appellants insisted it was worth more and demanded over Rs. 4 crore. The court gave them repeated chances to either match that price, deposit the money, or bring in another buyer willing to pay more. They failed to do any of this. As a result, the single judge confirmed the sale to the respondent at Rs. 3 crore.

The appellants challenged this decision before a larger bench, asking for more time to find a better buyer. The High Court rejected their appeal, finding that they had already been given ample opportunity and had not fulfilled any of the court's conditions. The judges upheld the original order, confirming the sale at Rs. 3 crore and dismissing the appeal as meritless.

This case illustrates how courts handle property disputes among multiple heirs when physical division is impossible, emphasizing that parties must act on opportunities given by courts rather than indefinitely stall proceedings.
