Conviction under section 22 of Emigration Ordinance 1979
PLJ 2023 Cr.C. (Note) 125 · Lahore High Court
This case involved Muhammad Naeem-ul-Haq, who was convicted by a trial court for posing as an unauthorized overseas employment promoter. He had taken Rs. 700,000 from a complainant, promising to send the complainant's son to America for employment, but failed to deliver on this promise. He was convicted under the Emigration Ordinance, 1979, receiving four years' imprisonment under Section 17 and another four years under Section 22 (running concurrently), along with fines and compensation to the complainant.
Naeem-ul-Haq appealed to the Lahore High Court, but his lawyer did not contest the conviction itself-only asked for a reduced sentence, citing that this was his first offense and he had already served over a year in custody. The complainant's lawyer did not object to this request.
The High Court upheld the conviction, finding the prosecution's evidence credible and consistent. However, it agreed to reduce the sentence to time already served, while keeping the fine and default sentence intact. The appellant was given one month to pay the fine.
This case illustrates how courts balance punishment with rehabilitation, particularly for first-time offenders. The judgment emphasizes that criminal justice aims not just to punish, but to allow individuals the chance to reform, provided this doesn't undermine the seriousness of the offense or society's interests.
