United Bank Ltd. Through Regional Chief Executive UBL through Manager Shara-e-Hali Quetta V. Fareedullah Khan and another,
PLJ 2022 Quetta (Note) 57 · Balochistan High Court
This case involved a bank employee, Fareedullah Khan, who worked as a cashier at United Bank Limited. After being transferred from Quetta to Sohbat Pur, he failed to report for duty, citing illness and domestic problems. Following an inquiry, the bank terminated his employment in 2007 for continuous absence.
He appealed internally and then through the labour courts. The Labour Court upheld his termination, but on appeal, the Labour Appellate Tribunal partly sided with him, reducing the penalty from termination to compulsory retirement instead. The bank was unhappy with this reduction and challenged it before the Balochistan High Court.
The High Court upheld the Tribunal's decision and dismissed the bank's petition. The judges reasoned that while the employee's absence from duty was indeed proven, there was no evidence that he was a habitual offender who repeatedly absented himself. Given his long service of 19 years and an otherwise clean record, outright termination without any benefits was too harsh a punishment. The court emphasized the legal principle that punishment should be proportionate to the wrongdoing, citing precedents that recognize mercy as the rule and severe punishment as the exception, especially for first-time or less serious infractions.
This case matters because it reinforces worker protections against disproportionate disciplinary action, affirming that employers and tribunals must weigh an employee's overall service record and the severity of misconduct before imposing career-ending penalties like termination without benefits.
