Asif Khan V. Anti-Terrorism Court Dera Allah Yar and another,
PLJ 2022 Quetta (Note) 15 · Balochistan High Court
This case concerns Asif Khan, who was accused of abducting two men, Mahram Ali and Allah Dina, for ransom along with co-accused, allegedly armed with rocket launchers. An FIR was registered against him under the Pakistan Penal Code for kidnapping for extortion. After investigation, the case was sent for trial before the Anti-Terrorism Court (ATC) in Dera Allah Yar. The accused sought to have the case transferred to an ordinary criminal court instead, arguing it should not be tried as a terrorism case. The trial court rejected this request, and Asif Khan challenged that rejection before the Balochistan High Court.
The High Court examined the FIR, investigation records, and statements of the victims, which indicated the abduction was carried out to demand ransom. Under the Anti-Terrorism Act, 1997, kidnapping or abduction for ransom is specifically listed as an offence that must be tried exclusively by Anti-Terrorism Courts, not ordinary courts. Since the facts of the case fit this definition, the High Court held that the trial court had correctly assumed jurisdiction and framed charges accordingly.
The High Court dismissed the petition, finding no merit in the challenge. This judgment reinforces that cases involving kidnapping for ransom fall squarely within the special jurisdiction of Anti-Terrorism Courts, regardless of attempts to shift them to regular criminal courts, due to the serious and specific nature of the offence as defined by law.
