PLJ 2022 Quetta 21 · Balochistan High Court
This case involved a long-running family land dispute over inherited property in Quetta, Balochistan. The petitioners, descendants who inherited land through a recorded mutation, claimed they owned and possessed the property but that their relatives, the respondents, had illegally trespassed on it after a boundary wall was built. The respondents argued they had been in proprietary possession of the land since 1971, claiming it came to them through a private property exchange with the petitioners' predecessors, and that the suit was time-barred.
Both the trial court and the first appellate court had ruled against the petitioners, favoring the respondents' version based on oral testimony. The Balochistan High Court, however, found this to be an error. It held that the petitioners held documented ownership through an inheritance mutation, which carries a legal presumption of truth. The respondents failed to produce any documentary evidence proving forty years of cultivation or possession, and could not even specify when their claimed "adverse possession" began. The lower courts had ignored this missing evidence and wrongly relied on oral claims instead.
The High Court ruled that mere possession, however long, does not create ownership rights, especially since Pakistani courts have held that adverse possession claims conflict with Islamic legal principles. It declared the petitioners the lawful owners entitled to possession and allowed their revision petition, overturning both lower court decisions. The case highlights the importance of documentary land records over unsupported oral claims in ownership disputes.
