Term ‘police authorities’ used in Section 22-A(6), Cr.P.C. is wide enough to include FIA

PLJ 2022 Lahore (Note) 83 · Lahore High Court

This case involved the National Bank of Pakistan and one of its officers, who were being investigated by the Federal Investigation Agency (FIA) over allegations of illegally issuing loans and money laundering. The bank went to the Lahore High Court asking it to use its constitutional writ jurisdiction (Article 199) to stop or quash the FIA inquiry, claiming the agency was exceeding its authority and harassing its employees.

Before examining the merits, the court had to decide whether the petition was even allowed to be filed directly in the High Court, given that the law provides another remedy: under Section 22-A(6) of the Criminal Procedure Code, a person who feels wronged by "police authorities" (such as through non-registration of a case, unfair transfer of investigation, or excess of power) can complain to an "ex-officio justice of peace," usually a Sessions Judge.

The key legal question was whether the FIA counts as a "police authority" under this section. The court held that it does, since FIA officers are given the same powers, duties, and status as provincial police officers under the law that created the agency. Therefore, people with complaints against the FIA can and should go to the justice of peace first, rather than directly to the High Court.

Since this alternate remedy existed, the court ruled the writ petition was not maintainable and dismissed it, directing the bank to pursue its complaint through the justice of peace instead. This decision clarifies that FIA actions are subject to the same local judicial oversight mechanism as regular police, rather than requiring direct High Court intervention.
