Justice of Peace Jurisdiction in FIA Matters
PLJ 2022 Lahore (Note) 83 · Lahore High Court
This judgment from the Lahore High Court addresses a key legal question: whether the Federal Investigation Agency (FIA) falls under the term "police authorities" as used in Section 22-A(6) of the Code of Criminal Procedure, and whether that affects where people can seek relief against FIA actions.
The case arose when the National Bank of Pakistan and one of its officers challenged an FIA inquiry into alleged illegal loan issuance and money laundering. They asked the High Court to order the FIA to drop the inquiry and to stop allegedly harassing bank employees, arguing no proper legal procedure was followed.
The court focused first on whether the petition was even maintainable, given that Section 22-A(6) allows an "ex-officio Justice of Peace" (a Sessions Judge or Additional Sessions Judge) to issue directions to police authorities about non-registration of cases, improper transfer of investigations, or excesses committed during investigations. The court held that FIA officials, who exercise the same powers as provincial police under the law, do qualify as "police authorities" under this provision. Therefore, aggrieved persons can approach a Justice of Peace for complaints against FIA conduct, just as they could against provincial police.
Since this alternate remedy existed and was adequate, the court ruled that the writ petition under Article 199 of the Constitution was not maintainable, and dismissed it accordingly. This matters because it clarifies that people aggrieved by FIA investigations have a quicker, more accessible local remedy before resorting to the High
