Dr. Muhammad Arif V. Muhammad Anwar and 3 others ,

PLJ 2022 Cr.C (Note) 42 · Balochistan High Court

This case involved a man, Dr. Muhammad Arif, who filed a criminal complaint (FIR) alleging that four men broke into his house at night, tried to attack his brother, and shot him when he intervened, causing a bullet injury. During the trial, after the prosecution had presented some witnesses but before all evidence was recorded, the accused persons applied under Section 265-K of the Criminal Procedure Code, asking the trial court to acquit them early based on a medical board report suggesting the complainant's injury was self-inflicted rather than from gunfire. The trial court accepted this application and acquitted the accused without letting the prosecution complete its evidence. The complainant appealed this acquittal to the Balochistan High Court.

The High Court set aside the trial court's order. It held that while judges do have power under Section 265-K to acquit an accused early to prevent abuse of the judicial process, this power should only be used when it is obvious from admitted facts that no offence is made out. Here, there was still oral and documentary evidence, including a disputed medical certificate, that needed to be properly tested through trial. Fairness required giving the prosecution a full opportunity to present its evidence before deciding the case, rather than cutting the trial short. The court emphasized that normal trial procedures should be followed unless truly exceptional circumstances exist, and sent the case back for a fair, complete trial.
