Muhammad Arif and others V. State through Prosecutor General Balochistan Quetta ,

PLJ 2022 Cr.C (Note) 28 · Balochistan High Court

This case involved two rival criminal complaints arising from the same late-night incident on 3 April 2018 in Quetta, where members of two families accused each other of attacking one another with sticks and firearms. One FIR (No. 65) accused Muhammad Arif and others of attacking the complainant and his daughter with sticks, causing injuries. A separate FIR (No. 66), lodged by one of the accused, alleged that the complainant's side had entered his house and opened fire on his brother. These are known as "cross" or "counter" cases, since they stem from the same event but present opposing versions.

Instead of being tried together by the same court, the two cases were split, heard separately by different judges, and the petitioners were convicted in one case (for causing hurt) without the court considering the related case or its evidence.

The Balochistan High Court held that this was improper. It explained that when cross cases arise from one incident, the law, though silent on an explicit rule, follows a well-established practice: both cases must be tried together by the same court, with judgments delivered simultaneously. This is to avoid wrongful convictions based on an incomplete picture, prevent contradictory verdicts, and allow the court to fairly determine who was the aggressor and who was aggrieved. Because this fair procedure was not followed, the court partly accepted the revision petition, recognizing the importance of considering both sides' evidence before convicting anyone in such intertwined disputes.
