Domestic Violence (Prevention and Protection) Act 2013 explained in a Judgment

PLJ 2022 Cr.C. (Note) 154 · Sindh High Court

This case involved a dispute between separated parents over their minor child, Kian Munir. The mother filed a petition under the Domestic Violence (Prevention and Protection) Act, 2013, alleging domestic abuse, and the Magistrate issued a notice directing the father to produce the child in court. The father challenged this order, arguing that the Magistrate lacked jurisdiction and that custody matters should instead be handled under the Guardian and Wards Act. After losing before the Sessions Court in revision, he approached the Sindh High Court.

The High Court dismissed his application and upheld the lower courts' orders. The judge explained that the Domestic Violence Act was specifically created to protect the most vulnerable members of society, women and children, who often cannot speak up about abuse due to fear of being hurt, abandoned, or thrown out of their homes. The court noted that the Act allows an aggrieved person to file a complaint before a Judicial Magistrate, who can issue notices and even grant temporary custody of the victim. Since the mother had made specific allegations of abuse, the Magistrate was right to take up the case under this law.

The court held that the father still had full opportunity to defend himself and prove his innocence before the Magistrate, and that his challenge was merely an attempt to stall proceedings early on. This case matters because it reinforces that courts should not allow procedural objections to undermine the protective purpose of domestic violence legislation.
