Filing of Appeal during Summer Vacations
PLJ 2021 Lahore (Note) 74 · Lahore High Court
This case arose from a family dispute over maintenance payments for two minor children. After the dissolution of his marriage, the children's mother filed a suit seeking maintenance, reimbursement of delivery expenses, and return of dowry articles. The Family Court ordered the father to pay interim maintenance, but when he failed to pay on time, the court struck off his defence and passed a decree against him granting monthly maintenance to the children.
The father then tried to appeal this decision, filing his appeal on 21 August 2010, during the courts' summer vacations. The Additional District Judge dismissed his appeal as time-barred, reasoning that it was filed too late.
The Lahore High Court disagreed. It held that under Section 4 of the Limitation Act, 1908, a person has the choice to either file an appeal during court vacations or wait until the courts reopen and file it then. Since the father could have validly filed his appeal as late as 1 September 2010 (when courts reopened), his filing on 21 August 2010 was actually within time, not late.
The High Court therefore set aside the order dismissing the appeal and directed the Additional District Judge to hear the appeal on its merits. This case matters because it clarifies that litigants are not penalized for filing appeals during court vacations, protecting their right to a fair hearing rather than losing cases on technical timing grounds.
