Condition of Divorce Mentioned in Nikahnama
PLJ 2021 Lahore 485 · Lahore High Court (Multan Bench)
This case concerns a couple whose marriage broke down, leading to multiple lawsuits over maintenance, dowry, dower (mahr), and money claimed under conditions written in their nikahnama (marriage contract). The husband, Muhammad Sajjad, challenged decisions by family courts and an appellate court in Punjab.
One key dispute involved a five-marla house promised as part of the dower. The court examined the marriage contract documents and testimony from the marriage registrar, finding that the property description had been legitimately amended with both parties' consent. The court upheld the lower courts' decision awarding the house to the wife.
The more significant legal question involved Rs. 500,000 that the wife claimed under a clause in the nikahnama stating the husband must pay this amount if he ever divorced her or took a second wife. The lower courts had ordered him to pay this sum. The High Court disagreed, ruling that under Islamic law, a husband holds an absolute, God-given right to divorce his wife, and no contractual condition can restrict or penalize the exercise of this religious right. The judge cited Quranic verses, Hadith, and Islamic legal scholarship to support this reasoning.
As a result, the court partly accepted the husband's petition, setting aside the part of the ruling that penalized him financially for divorcing or remarrying, while upholding the other financial awards to the wife. The case matters because it clarifies that marriage contract clauses cannot override or restrict a husband's fundamental right to pronounce divorce under Islamic law.
