Re-Investigation can be permitted under special circumstances

PLJ 2020 · Balochistan High Court

This case involved the National Accountability Bureau's attempt to reopen a corruption investigation against Abdul Hakeem, a General Manager at Pakistan State Oil, and other officials, long after it had been officially closed. NAB had investigated the respondents in 2002, found no evidence against them, and formally closed the case with court approval in 2005. Years later, in 2009, NAB sought permission to reinvestigate the same matter. That request went through a lengthy legal back-and-forth, eventually landing back before the Accountability Court, which rejected NAB's application in 2019. NAB then challenged that rejection before the Balochistan High Court.

The High Court dismissed NAB's petition, upholding the trial court's refusal to allow reinvestigation. The court explained that while re-investigation is legally possible even after a case is closed, it can only happen if genuinely new evidence has emerged that was not available earlier. Courts should not simply rubber-stamp an investigator's request; they must be satisfied there are valid reasons. In this case, the same allegations had also been examined through four separate administrative inquiries by the Customs Department, and the respondents were cleared each time. Given that 17 years had passed with no fresh evidence presented, the court found that continuing to pursue the respondents would be unfair and amount to misuse of the legal process.

This ruling matters because it sets a check on investigative agencies like NAB, preventing indefinite harassment of individuals through repeated investigations without solid new justification, reinforcing fairness and finality in legal proceed
