Lal Bibi and 10 others V. Abdul Rehman and 8 others,

PLJ 2020 Quetta 16 (DB) · Balochistan High Court

This case involved a family dispute over inheritance property left by a deceased man, Abdul Hayee, who allegedly purchased various properties in Quetta and Mastung through "benami" (nominal) transactions. His heirs filed civil suits seeking declaration, correction of revenue records, partition, and injunctions regarding these properties. The two related suits were consolidated by the trial court, and eventually both suits were decided based on a compromise between the parties, following an earlier remand caused by an appeal from an outside party (intervener).

Some heirs, however, later challenged that compromise decree by filing an application under Section 12(2) of the Civil Procedure Code, arguing they had not received their rightful shares. The trial court dismissed this application, but on revision, the Additional District Judge sent the matter back to the trial court, directing that issues be framed and evidence recorded before deciding the application afresh.

The petitioners then approached the High Court, arguing this remand was improper. The Balochistan High Court dismissed the petition, holding that while framing issues is not always mandatory in Section 12(2) applications, in cases like this one, where facts are disputed, parties must be given a fair chance to present evidence before a decision is made. Finding no illegality in the lower court's order, the High Court upheld the remand, emphasizing the importance of due process and fair hearing in resolving property and inheritance disputes.
