Granting Custody while granting visitation
PLJ 2020 Islamabad 113 · Islamabad High Court
This case involved a custody dispute over an eight-year-old boy, Waliyaan, following the breakdown of his parents' marriage. His mother had moved to the UK for higher education, originally with the father's agreement that she could take Waliyaan with her, provided his visa was approved. However, the boy's visa application was rejected, so he stayed in Pakistan with his maternal grandparents while his mother went abroad alone. The couple later divorced. The father then sought custody, while the mother and her parents fought to retain guardianship and custody.
The Family Court and the Appellate Court both ruled in favor of the father, granting him custody, while setting up a visitation schedule for the maternal grandparents and allowing the mother custody whenever she visited Pakistan. The mother and her parents challenged these decisions before the Islamabad High Court.
The High Court upheld the custody award to the father, reasoning that since the child could not join his mother in the UK, awarding custody to the father was not improper, especially as there was no finding that he was unfit to care for his son. However, the Court objected to one part of the lower court's ruling, that barred the mother from ever seeking permanent custody if she returned to Pakistan. The High Court struck down this restriction, holding that any future custody claim must be decided afresh based on the child's best interests at that time. The petition was therefore partly allowed.
