Vendee has to prove Title, Consideration and Delivery of Possession

PLJ 2018 · Lahore High Court

This case involved a woman, Surraya Bibi, who owned about 15 kanals of land. A sale deed showed the land had been transferred to her nephews, the sons of her brother. She sued to cancel the sale deed, claiming she had only leased the land to her brother, who fraudulently used that arrangement to create a fake sale in his sons' favor, without her consent or any payment. The trial court initially decreed in her favor, but after remand and additional evidence, both the trial court and the appellate court dismissed her suit and upheld the sale.

She then approached the Lahore High Court. The Court ruled in her favor, setting aside the lower courts' decisions. It held that to prove a valid sale, the buyer must show three things: the seller had legal title, proper payment was made, and possession was actually handed over. Simply having a registered sale deed does not automatically prove these facts if the transaction is disputed - the burden falls on the buyer to prove it.

The Court also found a serious legal defect: the sale deed, being a document creating financial obligations, legally required at least two proper attesting witnesses. Here, one signatory was merely an "identifier" of the seller, not a true witness to the transaction, making the document technically inadmissible as evidence.

The Court explained that while it normally does not disturb matching findings by lower courts, it can and must intervene when those findings result from clear misreading of evidence or violate mandatory legal requirements, as happened here.
