Suspension of Registration of Sales Tax Registered Person

PLJ 2018 · Lahore High Court

This case was about whether tax authorities could suspend a business's sales tax registration without giving it prior notice or a chance to be heard. The petitioner, a lubricants company, challenged Rule 12 of the Sales Tax Rules, 2006, which allowed the Commissioner to suspend a registered person's tax registration immediately, without notice, based on suspicions like fake invoices, tax evasion, or fraud, pending further inquiry.

The Lahore High Court ruled that this part of Rule 12 was unconstitutional. The court held that suspending a business's registration effectively stops it from operating, which infringes on the constitutional right to conduct lawful trade or business (Article 18) and violates the right to a fair trial and due process (Article 10-A). Since the allegations involved serious, almost criminal-type accusations like fraud and evasion, the affected person deserved an opportunity to be heard before such a drastic action was taken, not just afterward. The court also found that an administrative rule cannot go beyond what the main law (the Sales Tax Act) actually permits, and that natural justice principles require fairness whenever a decision could seriously affect someone's rights or livelihood.

As a result, the court struck down the part of Rule 12 allowing suspension without prior notice, ruling that tax authorities must give notice and a hearing before suspending anyone's sales tax registration. This decision reinforces that due process protections apply even in tax administration and businesses cannot be punished before being heard.
