At bail stage it is neither permissible nor desirable to make a deep scrutiny
PLJ 2018 Sh.C. (AJ&K) 23 · Azad Jammu & Kashmir High Court
This case is about a wife accused of attacking her husband and seeking anticipatory (pre-arrest) bail in a criminal case. The husband alleged that his wife cut off his penis with a sharp weapon while he slept, motivated by a marital dispute. Police registered charges under sections of the Pakistan Penal Code dealing with causing hurt. The accused was initially granted pre-arrest bail by a lower court, but this was later withdrawn. She then filed a revision petition before the Azad Jammu and Kashmir High Court challenging that withdrawal, arguing the case was fabricated, inconsistent, and malicious, and also citing poor mental and physical health.
The High Court explained key legal principles: at the bail stage, courts should not conduct a deep examination of evidence; pre-arrest bail is an extraordinary remedy that must be used cautiously, especially in serious offences carrying heavy punishment; and a good ground for bail after arrest does not automatically justify bail before arrest. The court also noted that bail on medical grounds can be granted only if the illness is serious enough that proper treatment isn't possible in custody.
In this case, the accused had already received the extra time she requested for treatment, failed to appear in court even when summoned, and avoided appearing in person during the hearing. Because of this conduct, the court refused her pre-arrest bail and dismissed her petition, reinforcing that pre-arrest bail is a limited remedy not meant for routine use or to avoid accountability.
