Prosecution must establish that chain of custody was unbroken, unsuspicious, indubitable, safe and secure
PLJ 2018 SC (Cr.C.) 90 · Balochistan High Court
This Supreme Court judgment deals with several narcotics cases together because they raised the same important legal questions about how drug evidence must be handled before someone can be convicted.
Under Pakistan's Control of Narcotic Substances Act, 1997, once police seize a suspected narcotic substance, a sample must be sent to a Narcotics Testing Laboratory for analysis. The Government Analyst's report is given strong evidentiary weight in court and is treated as conclusive unless rebutted. Because so much weight rests on this report, the Court examined the rules governing how samples are collected, preserved and tested.
The Court held that the "chain of custody" - the unbroken record of who handled the sample from the moment of seizure until it reaches the laboratory - must be safe, secure, and free of suspicion. Any gap or irregularity in this chain undermines the reliability of the final report.
The Court also analysed the Control of Narcotic Substances (Government Analysts) Rules, 2001, distinguishing between rules that are merely "directory" (good practice, non-compliance doesn't invalidate the report) and those that are "mandatory" (essential, non-compliance invalidates the report). It ruled that the requirement to record full testing protocols in the analyst's report is mandatory, while other procedural requirements like multiple signatures or copies are merely directory.
This judgment matters because it sets clear standards protecting accused persons from convictions based on unreliable or improperly documented drug testing.
