PLJ 2018 SC 95
PLJ 2018 SC 95 · Lahore High Court
This Supreme Court order dealt with a dispute over whether an appeal by the Capital Development Authority (CDA) against Hashwani Hotels was filed too late. The case originated from a suit by Hashwani Hotels seeking declaration, possession, and specific performance relating to a lease, which the trial court dismissed but the Islamabad High Court later decided in the hotel's favour. CDA appealed to the Supreme Court. Hashwani Hotels then asked for the appeal to be dismissed, arguing that under the Supreme Court Rules, an appeal must be filed along with a certified copy of both the judgment and the decree, and since CDA only attached the decree-sheet weeks later, the appeal was effectively 44 days late.
CDA argued that the decree-sheet simply did not exist yet when they filed their appeal, since the High Court had not prepared it immediately after the judgment, and the delay was not their fault.
The Supreme Court examined when a decree actually comes into existence and found there was no clear record of when the decree-sheet was finalized by the High Court. Since this date was unclear and not caused by the appellants, the Court held the appeal could not be confidently said to be time-barred, and even if it were, the delay deserved to be condoned. The application to dismiss the appeal was therefore rejected. The case matters because it clarifies how limitation periods are calculated when procedural delays in preparing court documents are not the fault of the appealing party.
