PLJ 2018 SC 66
PLJ 2018 SC 66 · Islamabad High Court
This case was about tenants in Islamabad who were ordered to vacate rented properties because their tenancy periods had expired. The landlords used this expiry as the ground for eviction under the Islamabad Rent Restriction Ordinance, 2001, and the lower courts, including the Islamabad High Court, agreed and ordered eviction. The tenants appealed to the Supreme Court, arguing that even after the tenancy period ended, they remained "tenants" in the legal sense and could only be evicted on the specific grounds listed in Section 17 of the Ordinance (like non-payment of rent, subletting, or personal need of the landlord) — not simply because the lease term had ended.
The Supreme Court disagreed. It held that Section 6 of the Ordinance clearly states that a tenancy is no longer valid once its term expires. Reading this together with Section 17, the Court ruled that continuing to occupy the property after the tenancy period ends, without the landlord's written consent, amounts to a violation of the tenancy terms — which is itself a valid ground for eviction under Section 17. The Court rejected the argument that this made Section 6 redundant, saying such an interpretation would instead ignore it entirely and let tenants occupy property indefinitely despite having no legal right to do so.
The appeals were dismissed, meaning the eviction orders stood. The decision clarifies that landlords in Islamabad can seek eviction simply because a tenancy agreement's term has expired, without needing to prove another separate ground.
