PLJ 2018 SC 391

PLJ 2018 SC 391 · Supreme Court of Pakistan

This case involved a petition by Mst. Sughran Bibi, whose son Mohsin Ali was killed in what police described as an encounter. After the police version of events led to an FIR being registered, investigation completed, and a formal challan (charge sheet) submitted to the trial court, the mother filed her own private complaint giving a different account of how her son died, naming different circumstances around the police action. She then sought registration of a separate, second FIR based on her version of the incident. The Supreme Court examined a recurring legal question: can multiple FIRs be registered for different versions of the same occurrence, or must a new version be handled differently under the law.

The Court ruled that only one FIR can exist for a single incident involving a cognizable offence. Any alternate account of the same occurrence, given later, should ordinarily be recorded as a statement during investigation, not as a fresh FIR. However, a separate FIR becomes permissible if the new version concerns a genuinely different occurrence, a different set of accused persons, or discloses a distinct cognizable offence.

Since an FIR already existed, investigation had concluded, a challan was filed, and the petitioner's private complaint was already being tried in court, the Supreme Court held that registering a second FIR for her version of the same incident was not legally justified. The petition was dismissed. This judgment clarifies how Pakistani courts should handle competing narratives of the same crime, ensuring consistency in the FIR system while still protecting victims through alternative legal remedies like private complaints.
