Second FIR of the same incident is barred
PLJ 2018 SC 391 [Original Jurisdiction] · Supreme Court of Pakistan
This case, decided by the Supreme Court of Pakistan, dealt with a police encounter in which the petitioner's son, Mohsin Ali, was killed by local police. An FIR had already been registered about that incident, the police had completed their investigation, and a challan (police report) had been submitted to the trial court. The petitioner, Mst. Sughran Bibi, also filed a private complaint giving her own version of events, and that complaint had led to accused persons being summoned, with the trial already underway. She wanted the police to register a separate, second FIR based on her account of the same incident.
The Supreme Court refused this request and dismissed the petition. It held that only one FIR can exist for a single incident. If someone comes forward with a different version of the very same occurrence, that version should be recorded as a statement under Section 161 of the Criminal Procedure Code during investigation, or pursued through a private complaint, not treated as a fresh FIR. A second FIR can only be registered if the new version concerns a genuinely different occurrence or reveals a separate cognizable offence altogether.
This judgment matters because it clarifies the law on multiple FIRs for the same incident, preventing confusion, duplication, and potential misuse of the FIR process, while still protecting victims' rights through investigation procedures and private complaints.
