Dost Muhammad V. Additional Sessions Judge Barkhan at Rakhni and another,

PLJ 2018 Quetta 36 · Balochistan High Court

This case concerns a criminal trial in Barkhan that was put on indefinite hold because two key prosecution witnesses, including the complainant, had stopped appearing in court after allegedly becoming fugitives in a separate murder case. The trial court had accepted the prosecution's request to place the case in "dormant" status, meaning it would remain paused with no further proceedings until these witnesses became available, while the accused remained on bail.

One of the accused challenged this order before the Balochistan High Court, arguing that a criminal trial could not simply be shelved indefinitely just because some witnesses were unavailable, especially when other witnesses were ready to testify.

The High Court agreed with the petitioner. It examined Section 344 of the Criminal Procedure Code, which allows courts to adjourn or postpone proceedings, but only for a definite, reasonable period, with written reasons, not indefinitely. The court also noted other relevant provisions dealing with absent complainants and discontinuation of prosecutions, finding that none of them justified simply parking the case in limbo.

The judges ruled that a trial, once begun, must continue and be brought to completion. The fact that some witnesses had absconded did not entitle the court to freeze the entire case indefinitely. As a result, the High Court struck down the trial court's order and directed it to proceed with the case according to law.

This decision matters because it reinforces that criminal trials cannot be left pending indefinitely due to witness unavailability, protecting the right of accused persons to a timely and continuing trial process.
