PLJ 2018 Quetta 158 · Balochistan High Court

This case involved a family property dispute in Quetta. A father, Muhammad Ameen, owned land along with constructed shops. He had one son and several daughters. In 2009, he executed a disinheritance deed against his son, Feroz, accusing him of disobedience, and published this in a newspaper. Shortly after, he gifted the entire property to his three unmarried daughters through a mutation, excluding his son and married daughters.

After the father's death, the son sued for declaration, possession, partition, and cancellation of the mutation, arguing the gift was actually meant to cut him out of his rightful inheritance. The trial court and the appellate court both ruled in his favor, declaring the gift invalid.

The daughters challenged this before the Balochistan High Court. The High Court upheld the lower courts' decisions, ruling that disinheriting an heir through a so-called Aaq-Nama (disinheritance deed) has no legal or religious sanctity under Islamic law. A gift made with the real intention of depriving a legal heir of their rightful share is invalid, regardless of the formal requirements of a gift being met. The court did note that since the daughters had paid Rs. 200,000 to their father as part of the gift arrangement (making it a Hibba-bil-Awez, a gift for consideration), the son was required to return that amount to them.

This judgment reaffirms that parents cannot lawfully disinherit legal heirs under Islamic inheritance law simply by framing a transfer as a gift, protecting the inheritance rights of children.
