Mujeebullah Gharsheen and another V. Government of Balochistan through Chief Secretary and 3 others,

PLJ 2018 Quetta 150 · Balochistan High Court

This case, decided by the Balochistan High Court, dealt with the question of whether government employees and civil servants have an unrestricted right to go on strike, hold demonstrations, or stage sit-ins (dharnas), particularly ones that block public roads or disrupt essential services like education and healthcare.

The court held that while civil servants have the right to form associations, this right is not absolute and is subject to reasonable restrictions imposed by law, particularly to protect public order. Strikes and sit-ins by civil servants are not recognized or protected under existing law and are, in fact prohibited. The court ruled that any civil servant or employee of a statutory body (except those legally classified as "workmen") who participates in such strikes or demonstrations is guilty of "misconduct" and should face departmental disciplinary action.

The judgment emphasized that disrupting schools, hospitals, and public thoroughfares through strikes violates the fundamental rights of ordinary citizens to education, healthcare, and free movement. It directed the Chief Secretary of Balochistan to consider amending the relevant conduct rules, and warned that if authorities failed to take disciplinary action against striking employees in the future, those responsible officials could themselves face contempt of court proceedings.

This ruling matters because it clarifies limits on public employees' right to protest and reinforces that government inaction against disruptive strikes can itself be held accountable by the courts, protecting the broader public's access to essential services.
