Sajjid Ahmed and others V. National Accountability Bureau through Director General and others,
PLJ 2018 Quetta 139 · Balochistan High Court
This case concerns several petitions filed before the Balochistan High Court by government officials accused of involvement in a scheme to appoint "bogus" (fake) teachers in the Education Department in Quetta and then arrange for their salaries to be paid, causing a financial loss to the public exchequer of over 43 lakh rupees. The National Accountability Bureau (NAB) had filed corruption references against the petitioners, including a retired officer, an ex-Deputy District Officer of Education, and accounts officials, alleging they colluded to fraudulently appoint seven teachers and activate their pay despite lacking proper authority or following required procedures.
The petitioners sought pre-arrest and post-arrest bail, arguing they had cooperated with the investigation, that similar allegations against co-accused in a related reference had already resulted in confirmed bail from the same court, and that some petitioners had documented reasons showing they could not have committed the alleged acts (such as being abroad or retired at the relevant time, or not holding the financial powers attributed to them).
The court noted that unresolved questions—such as whether officers actually had the authority to initiate salaries and whether accounts officials violated any rules—were matters for the trial court to decide. Relying on its earlier judgment granting bail to similarly situated co-accused on almost identical allegations, the High Court found a case for bail was made out and granted bail to the petitioners, while the actual trial would proceed separately.
