Ahmed Khan Floraid Company through Owner V. Secretary Mines & Minerals, Government of Balochistan and 2 others,
PLJ 2018 Quetta 136 · Balochistan High Court
This case is about a dispute over mining rights in Balochistan. The petitioner, Ahmed Khan Floraid Company, wanted the government to issue him a No Objection Certificate (NOC) so he could obtain a prospecting license to mine fluorite in a particular area. He claimed he was qualified and entitled to the NOC, and that a rival company (Respondent No. 3) had obtained its own mining rights through fake and tampered documents, which had already been cancelled through earlier legal proceedings, yet that company was still illegally mining in the area.
The petitioner asked the High Court to declare him deserving of the NOC, to order the government to issue it to him, and to stop the rival company's ongoing mining activity.
The court did not rule on the merits of these claims. Instead, it dismissed the petition on procedural grounds, finding that the petitioner had not exhausted the alternate remedies available to him. Specifically, there were two administrative forums, the Secretary of Mines and Minerals and another department, where he could have sought redress but had not done so. The court explained that a constitutional petition can only be filed when no other effective remedy exists, citing Article 212(2) of the Constitution, which limits courts from intervening in matters that fall under the jurisdiction of administrative tribunals.
The petition was dismissed, but the petitioner was left free to pursue his grievance through the proper administrative channels first.
