Noor Ahmed and another V. Deputy Commissioner, Kharan and 3 others,

PLJ 2018 Quetta 133 · Balochistan High Court

This case involved a young woman who took the entry test for admission to Bolan Medical College and topped the merit list. However, when she went to check her result, she discovered that her local residency certificate for Kharan district had been cancelled by the Deputy Commissioner, acting on a recommendation from another official. This cancellation meant she could lose her spot despite her top ranking, potentially benefiting another candidate who had placed fourth on the merit list.

The petitioners, the young woman and a relative, challenged this cancellation in the Balochistan High Court. They argued that they were genuine, longtime residents of Kharan, supported by decades-old identity documents showing their family's residence there since the 1970s and 1990s, including local certificates issued in 1994. They also argued that they had never been given a chance to defend themselves before their certificates were cancelled, and that notices about the proceedings had been sent to an address where they did not actually live.

The court found that the cancellation process was flawed and unfair. It noted that notices were deliberately sent to the wrong address, effectively ensuring the petitioners could not respond, and that an influential private individual appeared to have pushed hard to get them declared non-residents. The court criticized the Deputy Commissioner for acting hastily and illegally without giving the petitioners a hearing. Concluding that the petitioners had proven their genuine residency, the court accepted the petition, effectively restoring their local certificates and protecting the woman's rightful admission based on merit.
