Pakistan Railways Employees Cooperative Housing Society Ltd. through General Secretary, Quetta V. Haji Ghulam Haider and 3 others,
PLJ 2018 Quetta 122 · Balochistan High Court
This case concerns a housing society for Pakistan Railways employees in Quetta, which held a 99-year lease over railway land for residential development. The society filed a civil suit seeking declarations that it was the lawful lessee of the land, that certain individuals had no right to build on it, and seeking a permanent injunction against alleged encroachers, along with an order for proper demarcation of the property. The respondents contested the suit, with one claiming the land was actually used by a livestock research project (CASVAB) and another alleging the society itself had encroached on his property.
During trial, a local commission was appointed to inspect the disputed site. The commissioner's report noted irregularities, including the absence of the relevant land record official (Patwari) during the visit, which the society objected to at the time. Despite these objections, the trial court decided the case without resolving the objections or framing proper legal issues, and dismissed the suit. The appellate court upheld this decision without deeper scrutiny.
The Balochistan High Court found that both lower courts had acted hastily and failed to follow proper procedure, given that valuable property rights were at stake. It held that such cases must be decided on merits, after issues are properly framed and both sides given full opportunity to present evidence. The High Court set aside both earlier decisions and sent the case back to the trial court for a fresh, lawful decision. This judgment underscores the importance of procedural fairness in civil property disputes.
