Naseebullah Khan V. Abdus Samee Babar,

PLJ 2018 Quetta 109 · Balochistan High Court

This case involved a defamation lawsuit in which a former Customs and Sales Tax official sued a man for 5 billion rupees in damages. The plaintiff alleged that the defendant, falsely claiming to be Vice Chairman of a business council, held a press conference in 2008 accusing him of wrongdoing. These allegations were reported in several newspapers and broadcast on television. The plaintiff later showed that the defendant was not actually affiliated with the business organizations he claimed to represent, as confirmed by various chambers of commerce.

The defendant denied the allegations in his written statement, but the trial court closed his opportunity to produce evidence or record his own statement after he missed a few hearing dates, and then decreed the full 5 billion rupee claim against him without properly examining the evidence or discussing the issues framed in the case.

The Balochistan High Court found this improper. It held that even when a defendant fails to appear, a court cannot simply decree a case without evaluating the evidence already on record, especially in a case involving such a massive damages claim. The court stressed that both regular and ex-parte decrees must be based on proper appreciation of evidence, otherwise they are legally void. The appeal was partly allowed, meaning the trial court's decision was reconsidered rather than upheld outright. This case highlights the importance of fair hearing and evidence-based decision making in civil litigation.
