This case involved a police department employee who had originally been appointed as a Cook in 1999 on a family-support quota, following his father's death during service. In 2004, after applying for recruitment, he was appointed as a Driver Constable by the CCPO, Lahore, and served in that role for over a decade with a clean record.
In 2016, the CCPO withdrew his 2004 appointment order, claiming it was illegal because changing his cadre from Cook to Driver Constable violated rules, citing a Supreme Court of Pakistan judgment that had nullified out-of-turn and ante-dated promotions (often linked to gallantry awards).
The Punjab Service Tribunal disagreed. It held that the Supreme Court's ruling specifically addressed out-of-turn or ante-dated promotions and cases of officials transferred or deputed outside their proper cadre - not straightforward appointments like this one. Since the appellant was never promoted out of turn, nor was his case about deputation or transfer, the Supreme Court judgment did not apply to him. The Tribunal found that the department had wrongly relied on and misapplied that precedent to cancel a legitimate appointment made 12 years earlier.
As a result, the Tribunal set aside the 2016 withdrawal order and restored the appellant to his position as Driver Constable. This case matters because it shows courts scrutinizing whether government departments are correctly applying higher court rulings, protecting employees from having legitimate, long-standing appointments overturned based on precedents that don't actually fit their situation
