Fixation of increase in fee for Academic Year

PLJ 2018 Lahore 646 (FB) · Lahore High Court

This case involved City School Private Limited challenging a Punjab government law that limited how much private schools could increase their tuition fees each year, capping the raise at 5 percent (later increased to 8 percent) and applying it in some instances retrospectively. The school argued this restriction violated its constitutional rights to conduct business and trade freely under Article 18 of the Constitution.

A full bench of the Lahore High Court rejected the challenge and upheld the fee-capping law. The court reasoned that the right to run a business or profession under Article 18 is not absolute and can be reasonably regulated by law, especially when such regulation serves public interest. It noted that private schools have always operated under a licensing and registration system, and that fee regulation has historically been part of that framework even before the challenged amendment. The court also emphasized that education is closely tied to the right to life and dignity, and after the 18th Constitutional Amendment, education became an independent fundamental right under Article 25-A. Given this, the state has a legitimate interest in preventing commercialization and profiteering in education by regulating fee increases.

This judgment matters because it affirms the government's authority to regulate private school fees in the public interest, balancing business freedoms against the fundamental right to accessible, affordable education for children.
