Party cannot improve its case beyond pleadings

PLJ 2018 Lahore 1042 · Lahore High Court

This case involved a woman, Surraya Bibi, who claimed that land she owned was taken from her through a fraudulent sale deed. She had leased the land to her brother, but alleged he manipulated the arrangement into a sale in favor of his own sons. She sued for cancellation of the sale deed, declaration of ownership, and possession. The trial court initially ruled in her favor, but after the case was sent back for more evidence, it was dismissed, and her appeal also failed. She then approached the Lahore High Court.

The High Court examined whether the sale deed met the legal requirements to be valid, particularly whether it was properly witnessed. Under the law of evidence, such documents involving financial transactions must be attested by at least two genuine marginal witnesses. The court found that one of the supposed witnesses had merely acted as an identifier of the illiterate seller, not as a proper attesting witness, which made the document legally defective.

The court ruled that even though lower courts had reached the same conclusion (a "concurrent finding"), it could still intervene because the earlier decisions were based on misreading and ignoring evidence, and violated clear legal requirements. It held that the sale deed was inadmissible and wrongly relied upon, and ruled in favor of Surraya Bibi.

This case matters because it reinforces that courts can overturn even consistent lower-court rulings when there are serious legal errors, and it clarifies that proper witnessing of property documents is essential for their validity.
