Jurisdiction of Court of Protection matters for supervising care of mentally disordered person

PLJ 2018 · Lahore High Court

This case is about who can get court protection and appointed as a manager for the property of a mentally disordered person under Pakistan's Mental Health Ordinance, 2001.

The petitioners, whose mother was allegedly suffering from a mental disorder and living abroad, sought to be appointed managers of her property. Before approaching the Court of Protection, the law required them to first get written consent from the Advocate General, Punjab. That consent was refused because the mother did not reside within the territorial jurisdiction of the relevant Court of Protection, and neither she nor the petitioners appeared before the Advocate General's office in person. The petitioners argued that the Advocate General's consent was merely a clerical formality and that he had wrongly taken over powers belonging only to the Court of Protection, especially since the mother could not travel to Pakistan.

The Lahore High Court disagreed. It held that the Advocate General's consent is a substantive, meaningful check, not a rubber stamp. Its purpose is to confirm that there genuinely is a mentally disordered person, that the person and the relatives seeking guardianship live within the court's jurisdiction, and that the application is genuine. The court reasoned that since the Court of Protection must continuously supervise the person's care and property, both the disordered person and the manager must reside within its jurisdiction. The petition was dismissed, meaning the refusal of consent stood.
