Relaxation of Upper Age Limit

PLJ 2018 Islamabad 302 · Islamabad High Court

The case involved a police constable, Rashid Ameer, who applied for a promotion-related post of Assistant Sub-Inspector (ASI) in the Counter Terrorism Force of Islamabad Police. The advertised age limit was 25 years, and he was over-age by about four years. He sought relaxation in the upper age limit, citing rules made by the Establishment Division in 1993 and a later office memorandum that allowed extra years of age relaxation for government employees with continuous service, and additional relaxation for children of civil servants who died during service (his father, a DSP, had died while in service). The Inspector General of Police rejected his request, arguing that the Establishment Division's rules did not apply to Islamabad Police and that allowing relaxation would disrupt the completed recruitment process.

The Islamabad High Court disagreed. It held that the 1993 rules and the related office memorandum clearly entitled serving government employees with at least two years of continuous service to a 10-year age relaxation, and this benefit could not be denied to the petitioner. The court found that the authorities had failed to properly apply these rules and ruled in favor of the petitioner, allowing his writ petition.

This case matters because it reinforces that government employees have a legally protected right to age relaxation benefits under established rules, and administrative authorities cannot arbitrarily deny such entitlements by claiming non-applicability without proper justification.
