PLJ 2018 Islamabad 28

PLJ 2018 Islamabad 28 · Sindh High Court

This case involved newly appointed Civil Judges-cum-Judicial Magistrates in Islamabad who challenged a requirement that they pass a departmental examination before their services could be confirmed. The judges had been appointed in September 2012, but nearly three years later, in 2015, the Islamabad High Court amended its service rules and adopted Punjab's examination regulations, applying them retrospectively to these officers. The petitioners argued this was unfair and unlawful because no such exam requirement existed when they were appointed, they had never been given the mandatory prior training, the examination committee was improperly constituted with only two judges instead of the required three, an outside examiner wrongly both set and graded the papers, and the exam schedule crammed four attempts into ten months instead of the two years allowed under the rules. They also claimed discrimination, since similarly placed judges in other provinces (Khyber Pakhtunkhwa, Sindh, Balochistan) had this examination requirement waived, and other Islamabad judicial officers were not required to sit similar tests.

The court examined the relevant service rules and emphasized that completing training and passing the prescribed departmental examination is mandatory before confirmation, and that rules must be interpreted harmoniously and sensibly according to their plain meaning. This judgment matters because it clarifies how procedural rules governing judicial officers' confirmation must be properly and fairly applied, protecting judges from arbitrary or retrospective changes to their service conditions.
