PLJ 2018 Cr.C. (Lahore) 335 (DB)

PLJ 2018 Cr.C. ( · Lahore High Court (Multan Bench)

This case is about a man named Syed Javed Hussain who was convicted under Pakistan's Control of Narcotic Substances Act for allegedly possessing 12.35 kilograms of charas (hashish) found in ten packets on his motorcycle. A trial court had sentenced him to life imprisonment plus a fine. He appealed to the Lahore High Court's Multan Bench.

The High Court found serious flaws in the prosecution's case. First, the Chemical Examiner's report did not properly test and record results for each individual sample packet separately, as required by law, and relevant testing protocols had been crossed out, meaning compliance with proper procedure could not be verified. Courts have previously ruled that such lapses undermine the reliability of forensic evidence.

Second, and more critically, the two police investigating officers who testified actually contradicted the prosecution's own story. Their evidence suggested the narcotics were not found on the appellant riding his motorcycle as claimed, but were instead recovered from the house of another man, identified as "Ghulam Mustafa" (called "G"), where the appellant had merely been a guest at a family gathering when police raided the house. Since the narcotics were not found in the appellant's exclusive possession, he could not be definitively linked to the recovery.

Given these contradictions and procedural failures, the court ruled that the prosecution failed to prove guilt beyond reasonable doubt. The appeal was allowed, and the appellant's conviction was overturned. This case highlights how improper evidence handling and inconsistent police
