Delay in conclusion of Trial is ground for Bail

PLJ 2018 Cr.C. 730 (DB · Lahore High Court (Multan Bench)

This case concerns Muhammad Hussain, who was arrested in July 2015 under narcotics laws after police allegedly recovered 10.5 kilograms of opium from a jeep he was travelling in, with a co-accused allegedly carrying a similar quantity. He was charged under the Control of Narcotic Substances Act, 1997, an offence that normally carries strict restrictions on bail.

He had already applied for bail once before and been refused on merits. This time, he sought bail on a different basis: that his trial was taking far too long through no fault of his own. Court records showed that from March 2016 to October 2017, prosecution witnesses repeatedly failed to appear, even after the court issued arrest warrants to compel their attendance. The prosecution then filed an application that the court suspected was simply meant to drag the case out further.

The Lahore High Court held that the right to a speedy trial is a fundamental right, and that this principle applies especially strongly in special courts like those handling narcotics cases, where prolonged delays can effectively punish an undertrial prisoner without conviction. The court criticized the trial judge for failing to actively manage the case and for leaving the prisoner's fate to chance. Since there was no realistic prospect of the trial concluding soon, and the delay was not the petitioner's fault, the High Court granted him bail. The case reinforces that unreasonable delay in trial, not just the nature of the charge, can be valid grounds for bail.
