Authority of Selection Board cannot be Challenged
PLJ 2018 · Balochistan High Court
This case involved candidates who had applied for positions as Civil Judge/Judicial Magistrate and Qazi (BPS-18) in Balochistan, following a 2014 advertisement. The petitioners argued that their appointments should have followed the Government of Balochistan Recruitment Policy of 1991, which they claimed required zonal (district-based) allocation of posts, rather than being decided purely on merit. One petitioner also complained that candidates ranked lower than him on the merit list had been selected ahead of him.
The Balochistan High Court rejected these arguments. It explained that Article 27 of the Constitution bars discrimination in public appointments based on things like race, religion, caste, sex, residence or place of birth, but allows authorities the option, not an obligation, to reserve posts for certain areas to ensure fair representation. Since this reservation is discretionary, no candidate has an automatic right to demand a zonal quota system.
On the merit list complaint, the court found that although the petitioner ranked higher in the written exam, he scored lower marks overall after the interview, which placed him further down the list.
The court held that the Judicial Selection Board, composed of three High Court judges, is best positioned to judge candidates' abilities, and its decisions should not be overturned unless there is bad faith or the assessment has nothing to do with the candidate's actual competence. Both petitions were dismissed.
