Commercial and Service Activities of Civil Aviation Authority
PLJ 2017 SC 558 · Sindh High Court
This case concerns a dispute between the Sindh Revenue Board and the Civil Aviation Authority (CAA) over whether the Sindh government could charge sales tax on services CAA provides at airports, such as facilities for airlines and passengers. CAA challenged this tax in the Sindh High Court, which ruled in its favour and struck down the provincial tax as unconstitutional. The Sindh Revenue Board then appealed to the Supreme Court.
The Supreme Court upheld the High Court's decision and dismissed the appeal. It held that CAA performs functions that fall under subjects reserved exclusively for the federal government under the Constitution's Federal Legislative List, such as aviation, airports, and related regulatory matters. Although CAA charges fees for facilities like airport services, this does not transform its constitutionally mandated functions into "services" that a province can tax. The Court explained that CAA is structurally and financially controlled by the Federal Government: its governing board is dominated by federal appointees, its accounts are audited by the Auditor-General, its funds come largely from federal grants and loans, and it cannot even be wound up except by federal order. Allowing provinces to tax such federal functions would let them reach into other exclusively federal domains too, like railways, highways, or passports, which the Constitution does not permit. The ruling reinforces the boundary between federal and provincial taxing powers in Pakistan's federal system.
