PLJ 2017 Quetta 41 · Balochistan High Court

This case is about a woman named Gul Makai who died under suspicious circumstances after allegedly being mistreated by her in-laws. Her father, Abdul Ali, and the police initially filed an FIR, but not all suspected persons were named. Unsatisfied, the family filed a private criminal complaint accusing the woman's husband and in-laws of murdering her, alleging she had repeatedly complained about cruelty and violence in her marital home, and that a ligature mark and injuries on her body suggested strangulation.

The trial court, after hearing witnesses, acquitted the accused, finding the evidence unreliable. The father appealed the acquittal to the Balochistan High Court. The High Court examined the record and found that the witnesses were not eyewitnesses, gave inconsistent accounts of how they learned of the death, and that key informants were never brought to testify. It rejected the argument that the accused should be presumed guilty simply because the death occurred in their home and because of their alleged conduct afterward, stressing that the burden remains on the prosecution to prove guilt beyond reasonable doubt.

The Court also reaffirmed the well-established legal principle that an acquittal carries a "double presumption of innocence," meaning appellate courts should not interfere unless the acquittal was clearly arbitrary or against the evidence. Finding no such flaw, the High Court dismissed the appeal, upholding the acquittal. The case highlights how suspicion and family conflict alone, without solid evidence, cannot sustain a criminal conviction.
