Najeebullah V. The State,

PLJ 2017 Quetta 4 · Balochistan High Court

This case involved Najeebullah, a 17-year-old shopkeeper who was running Al-Saif Medical Store in Quetta without a valid drug-selling license. A Drug Inspector, during a routine inspection, seized medicine samples from the store and issued a show-cause notice, which went unanswered. After sanction was obtained, a complaint was filed against him under the Drugs Act, 1976, along with the Pakistan Penal Code provision on common intention.

When charges were framed, Najeebullah pleaded guilty and asked for the court's mercy. The trial court convicted him and sentenced him to two months' imprisonment plus a fine of Rs. 50,000 (or one month more in default of payment). He appealed, arguing that his young age, status as a student, and the fact that the seized medicines were not fake, substandard, or foreign-smuggled warranted leniency.

The Balochistan High Court noted that under the law, someone who pleads guilty cannot appeal their conviction itself, only the harshness of the sentence. Considering the appellant's juvenile age, his status as a student, the anguish and jail time he had already endured, and that the medicines involved were not counterfeit, the court reduced his prison sentence to the time he had already served. The fine and default sentence remained unchanged.

The case matters because it shows how courts can balance strict drug-law enforcement with compassion for young, first-time offenders, using sentence modification rather than overturning a guilty plea.
