PLJ 2017 Quetta 23 · Balochistan High Court
This case involved a mining company, Sino Pak Minerals, whose 30-year mining lease over land in Killa Saifullah, Balochistan, had been cancelled by the provincial Mines and Minerals authorities. The government accused the company of leaving the mining area idle, reporting no production, and failing to submit required quarterly progress reports under the Balochistan Minerals Rules, 2002.
The company challenged the cancellation, arguing it had never properly received the notices asking for progress reports or warning of cancellation, and so was never given a fair chance to respond before its lease was terminated. It cited genuine difficulties, including violent takeover of the mine site by armed men, deaths of foreign engineers during operations, and the illness of its managing director, as reasons for disruptions.
The Balochistan High Court found that the notices sent by the authorities had not been properly and verifiably served on the company. As a result, the company was "condemned unheard," meaning it was penalized without being given a genuine opportunity to explain itself, violating the basic legal principle of fair hearing (audi alteram partem).
The Court declared the cancellation orders void and of no legal effect, and directed the authorities to give the company proper notice and a fair opportunity before deciding the matter again. Separately, the Court rejected a rival claimant's request to be added to the case, since it had no ongoing legal interest in the lease after surrendering it earlier. This case underscores that government agencies must follow due process before cancelling valuable licenses or leases.
